TOTALLY PATRIOTS SCHOLARSHIP CONTEST
OFFICIAL RULES


1. HOW TO ENTER: Complete official entry form available at www.totallypatriots.com including an original essay of no less than 500 words and no more than 750 words in English summarizing one of the four most recently played Patriots' game and click on the "Submit" button. EACH QUARTER’S ENTRIES MUST BE RECEIVED BY 11:59 PM (ET) ON OCTOBER 11, 2008 (1st QUARTER DEADLINE), NOVEMBER 8, 2008 (2nd QUARTER DEADLINE), DECEMBER 6, 2008 (3rd QUARTER DEADLINE), AND JANUARY 3, 2009 (4th QUARTER DEADLINE). No illegible, incomplete, forged or altered entries will be accepted. Limit: one entry per person per week. Each entrant may submit up to four entries per quarter (one for each game). However, only one submitted entry will qualify as a winner per Quarter. All entries become the exclusive property of New England Patriots Charitable Foundation, Inc. (NEPCF) and will not be returned. Essay must be the exclusive original creation of the entrant, and may not have been previously published or won any other prize/award. By submitting entry, entrant represents that (s)he has the unrestricted right to submit the essay and the essay does not infringe upon any third party's proprietary or other rights. By entering, each entrant unconditionally assigns and transfers to NEPCF any and all rights which they now have or may in the future have to the essay including, without limitation, the copyright therein, in any medium whatsoever. NEPCF will have the unrestricted right to use, alter, publish, display or transfer each essay however it sees fit without further approval of or payment to entrant.

2. SELECTION OF WINNERS: During each quarterly period, commencing on September 7, 2008 (the First Phase), nine (9) winners (One (1) First place, two (2) Second place and six (6) Third place winners) will be selected each Quarter on the basis of composition, content and creativity of their essay by a panel of judges selected by NEPCF. Each essay will be given a score as determined by the judges. Quarterly winners will be selected on or about Friday following the week in which all eligible entries have been received for such Quarter. Winners of the Second Phase of judging will be selected from among all First Place Prize winners and other winners from the First Phase that have met a cut-off score on the basis of composition, content and creativity of their essay by a panel selected by NEPCF after the 16th week of the Contest. NEPCF's decisions on all matters relating to this Contest are final. All winners will be notified by email.

3. PRIZES: First Phase Prizes: Four (4) First Place Prizes/One (1) First Place Prize per Quarter: $5,000 in college* scholarship funds. ARV: $20,000.00; Eight (8) Second Place Prizes/two (2) Second Place Prize per Quarter: $2,500 in college scholarship funds. ARV: $20,000; Twenty-four (24) Third Place Prizes/six (6) Third Place Prizes per Quarter: $1,000 in college scholarship funds. ARV: $24,000. Limit one prize per family or household during the First Phase. Second Phase Prizes: One (1) Grand Prize: $15,000 in college scholarship funds; One (1) Runner-Up Prize: $10,000 in college scholarship funds; One (1) Honorable Mention Prize: $5,000 in college scholarship funds. TRV of all prizes: $94,000.00. All scholarship funds will be awarded in the form of a check payable to the college of winner's choice, the amount of which shall be applied toward tuition at such college at the time of winner's enrollment. If winner is not currently enrolled in college at the time prize is awarded, the amount of winner's prize will be held in trust by NEPCF until winner presents satisfactory evidence of their college enrollment which must occur no later than winner's 25th birthday. Prize will be forfeited after that date. Other restrictions may apply. All prizes will be awarded (assuming a sufficient number of eligible entries which shall not be less than 10 per Quarter). No substitution or transfer of prizes permitted. NEPCF shall be responsible only for prize delivery; not responsible for prize utility, quality or otherwise. Taxes and fees, if any, are the sole responsibility of prize winners

4. ELIGIBILITY: Contest only open to individual legal residents of the New England States (ME, VT, NH, MA, CT, RI) between the ages of 13 and 18 years of age as of September 7, 2008, except employees (and their immediate families and members of the same household) of NEPCF, New England Patriots, L.P., Gillette Stadium, Fidelity Investments and their affiliates, agents, judges and advertising and promotion agencies.

5. VERIFICATION OF WINNERS AND DELIVERY OF PRIZES:Winners will be required to sign an affidavit of eligibility and liability release and, where permitted, a publicity release. Prize may be awarded to an alternate winner if affidavit is not returned within 14 days after mailing to winner or if prize notification email is undeliverable or if winner does not respond to prize notification email within 7 days after the date of the email. If prize is won by a minor, it may be awarded in the name of a parent or legal guardian. NEPCF has the right to request evidence of appropriate age from any winner. Winners agree to use of name, address, likeness, and/or prize information for promotional purposes in any medium without additional compensation to the extent permitted by law, any such use with respect to minors to be subject to prior approval of parent or legal guardian.

6. GENERAL: This Contest is void outside the New England States and where prohibited or restricted by law and subject to all applicable federal, state and local laws and regulations. This Contest will be governed by the internal laws of the Commonwealth of Massachusetts. Any and all legal actions or claims arising in connection with this Contest must be brought in a court of competent jurisdiction within the United States of America. NEPCF and judges not responsible for late, lost, stolen, damaged, garbled, incomplete, misaddressed, postage due, or misdirected entries, mail or communications, for errors, omissions, interruptions, deletions, defects, or delays in operations or transmission of information, in each case whether arising by way of technical or other failures or malfunctions of computer hardware, software, communications devices, or transmission lines or data corruption, theft, destruction, unauthorized access to or alteration of entry materials, loss or otherwise. Further, NEPCF and judges not responsible for electronic communications which are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in entrant's e-mail account to receive e-mail messages. The use of automated software or computer programs to register or to enter the Contest is prohibited, and any individual who uses or attempts to use such methods to register or to enter will be disqualified. NEPCF disclaims any liability for damage to any computer system resulting from participation in, or accessing or downloading information in connection with, this Contest, and reserves the right, at its sole discretion, to modify, cancel, terminate or suspend this Contest should any virus, bug, technical failures, unauthorized human intervention or other causes beyond NEPCF's control corrupt or affect the administration, security, fairness or proper conduct of the Contest. In the event of any such cancellation, termination or suspension, a notice will be posted and the winners will be selected from among all eligible entries received prior to such time. NEPCF reserves the right, at its sole discretion, to disqualify any entrant from this Contest or any other promotion conducted now or in the future by NEPCF or any of its affiliates if his or her fraud or misconduct affects the integrity of the Contest. By participating in this Contest, each entrant accepts the conditions stated in these Official Rules, agrees to be bound by the decisions of the judges and warrants that s/he is eligible to participate in this Contest. By accepting prize, winner agrees to release NEPCF, its directors, employees, officers, and agents, including without limitation, its advertising and promotion agencies, from any and all liability, loss or damages arising from or in connection with the awarding, receipt, and/or use or misuse of prize or participation in any prize-related activities.

7. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, NEPCF RESERVES THE RIGHT TO PROSECUTE AND TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

8. WINNERS LIST: To obtain list of winners, send a self-addressed, stamped envelope to: Totally Patriots, One Patriot Place, Foxborough, MA 02035. Requests must be received by January 13, 2009. Winners list will be sent after selection of winners.
